Terms of Use

Draft. A lawyer has not reviewed this version yet.

Version 2026-11-02. These terms apply to new accounts from November 2, 2026. If you already had an account, they apply from December 2, 2026, and the previous terms apply until then.

The short version. This summary doesn't replace the terms below.

  • Plyed is in alpha. It can break, change or lose work, so keep your own backups.
  • The AI agent acts on your project: it can change or delete files, run commands and publish. Check what it does.
  • What you build is yours, and you're responsible for what you publish.
  • Polar takes your payment. Credits can't be turned into cash, apart from the refunds in sections 13 and 14.
  • If you're a consumer, the rights the law gives you always stay in place.

1. Who we are

Plyed is run by Federico Valla, trading as Software co / GA (Generally Available™), a sole trader, registered in the Czech Trade Register under number 19936176, VAT CZ686770119, at Revoluční 2137/8b, 110 00 Praha 1 - Nové Město, Czech Republic ("Plyed", "we"). You can reach us at help@plyed.co.

These terms are a contract between you and us for the Plyed desktop app, the web app, AI features, cloud workspaces, publishing and hosting, and this website (the "service"). You accept them when you create an account or sign in. If you don't agree, don't use the service. The contract is in English. We keep these terms at api.plyed.app/terms, and earlier versions are available from help@plyed.co.

A consumer is someone using Plyed mainly for purposes outside their trade, business or profession. A business user is anyone else. If you use Plyed for client work or to earn income, or buy with a company name or VAT number, you're a business user. Where a section treats the two differently, it says so.

2. Who can use Plyed

You must be at least 18 and able to enter a contract. Plyed isn't meant for children. If you use Plyed for an organisation, you confirm you may bind it, and "you" then includes that organisation.

You may not use Plyed if sanctions bar you from it, or from a place where sanctions or a model provider's terms forbid it. Some models aren't available in every region.

Keep your sign-in details safe. You're responsible for what happens under your account unless it happened without any fault on your part. Tell us at security@plyed.co if you think someone else got in.

3. Plyed is in alpha

Plyed is an early version. That means:

  • it may have bugs, slow down or stop working, and we offer no uptime commitment or service level;
  • features, limits and plans may change or be removed, under section 19;
  • work, chats, previews and published sites may be lost or stop working;
  • we may end the alpha or the service, under section 15.

Don't rely on Plyed alone for a site or business that would suffer serious harm if it stopped or lost data. Keep a copy of the project and the site's content elsewhere.

4. Where your work lives

Projects you create in the desktop app are stored on your computer. Some features copy data to our servers and providers: cloud workspaces, sync and managed Git, publishing and previews, AI requests, your own AI keys, deploy connections, project environment variables and CMS credentials. The Privacy Policy explains what goes where. We're not a backup service: keep your own copies and use version control.

5. The software

We license the Plyed software to you. We don't sell it. You get a limited, non-exclusive, non-transferable licence to install and use it for your own sites and for sites you build for clients, while these terms apply. We keep all other rights in the software and the service, including our prompts, model instructions and tool definitions, which we treat as trade secrets. Business users must keep them confidential. Third-party components keep their own licences.

Unless the law says we can't stop you, you may not: copy or redistribute the software; reverse engineer, decompile or extract it; systematically extract, scrape or publish our prompts, model instructions or tool definitions, or use them to build a competing product; or get around access controls, rate limits, credit metering or plan limits. Nothing here limits what mandatory law allows, including making a back-up copy, studying how the software functions, and decompiling it for interoperability under the conditions the law sets.

Prompt bundles we send to the app may carry a mark linked to your account, so that a leak can be traced.

Security research. Good-faith research on your own installation is welcome. Report it privately to security@plyed.co and give us a reasonable time to fix it before you publish anything. We won't take legal action against research that follows these rules, stays on your own installation and accounts, and doesn't touch other people's data or disrupt the service. Testing our hosted systems needs our written permission first.

6. Your content

It's yours. We claim no ownership of your projects, code, designs or published sites ("your content").

What you let us do with it. You give us a worldwide licence, free of charge and shared with no exclusivity, to host, store, copy, process, send, convert, back up and show your content, and to let our service providers and the AI providers that serve your requests do the same. We use this only to run, secure and support the service for you, to review content when we handle a report or investigate abuse or a security incident, to enforce these terms, and to comply with the law. Published sites and previews are also shown to the public. The licence ends when we delete your content. Copies in backups and caches and with providers follow the Privacy Policy and the provider's terms. We won't use your content in our marketing without your permission.

What you promise. You have the rights you need in your content, including anything you import, capture, convert or give to the agent, and using it with Plyed breaks no law or third-party right. Only import or capture a site, design or export if you own it or have permission. Someone else's designs, text, images, brands and look and feel stay theirs.

Starter code. Starter templates, and the code the editor itself writes into your project, are licensed to you under the MIT License in section 23, so you can use, change, publish and sell the sites you build. That doesn't extend to the Plyed software, or to the prompts and instructions behind it. Code from the AI agent is covered by section 7.

Feedback. If you send us ideas or feedback, we may use them freely, without paying you or owing you anything. This doesn't give us rights in your content.

7. AI features and the agent

You're working with AI. Plyed's chat and agent are AI systems. Their answers and code are generated by third-party models.

The agent decides its own steps. While working on what you asked, the agent can read, change, overwrite or delete files, run commands, fetch web pages, use connected tools, push code and publish sites. It chooses those steps itself, and web pages or files it reads can mislead it. In cloud workspaces, and when a chat starts work for you, it doesn't ask before each step. On your computer you choose which projects to trust. If you trust a project, its own code, including code the agent writes into it, runs with your user's permissions. Agent work also spends credits.

Protect your work. Take backups and use version control before you let the agent work on client work or live sites, and check its work before relying on it.

AI output may be wrong. It can be inaccurate, insecure, incomplete, or infringe someone's rights. It's not professional advice. Review and test it before you publish or rely on it.

Rights in output. As between you and us, we give you whatever rights we have in the output, so far as the law and the model provider's terms allow. The same or similar output may be produced for others, and output may not be protected by copyright in some places.

Model providers. Your prompts, relevant files, tool results and screenshots go to the model provider serving the request, usually through Vercel AI Gateway. You must follow Vercel's AI Product Terms and Acceptable Use Policy as they apply to AI Gateway, and the usage policy of the model's provider. In particular you may not use output to train a competing model, remove any AI label or marking, or use a model where it isn't offered. Providers differ on what they keep and whether they may train on requests. The model picker marks models whose provider we know may train. A model without that mark is not a promise that its provider doesn't. We don't promise zero retention or no training by providers.

Our own use. We don't use your prompts or project content to train or fine-tune AI models.

Show AI use. If your site or product puts AI in front of its own visitors, or publishes deep fakes or AI-written public-interest text, the required labelling and disclosure are your job.

8. Your own keys, coding tools and connected services

You may connect services such as your own AI keys, GitHub, Figma, Vercel, Sanity, Shopify, Webflow exports and MCP servers. Each runs under its own terms and your own account. You're responsible for being allowed to use it this way and for its costs. We don't control those services, and we may change or remove an integration.

Coding tools you run yourself. If a coding tool such as Claude Code, Codex or Cursor's CLI is installed on your Mac and you've signed in to it yourself, Plyed can start it and show its work in a chat. Plyed doesn't provide those tools, sign you in to them or resell their usage, and we're not affiliated with their makers. Their maker's agreement with you decides whether and how you may use them this way, and the maker can change that. We can't promise this keeps working, and we may switch it off at any time.

These tools act without asking by default. We ship the setting "Ask before Claude Code and Codex run commands" off, so Plyed approves their permission requests automatically. With it off, a tool can do anything your Mac user can, inside or outside your project, including editing or deleting files, running commands and using the network. You can turn it on at any time in Account; it also applies to Cursor. Even with it on, Plyed still approves, without asking, read-only commands inside your project, edits to files inside your project other than protected files, and reads of files inside your project or your Mac's temporary folder.

9. Acceptable use

You may not use Plyed, or let anyone use it, to:

  • publish or store anything illegal, including child sexual abuse material, or content that incites violence or harassment;
  • infringe copyright, trademark or other rights, including copying a site, brand or design without permission;
  • run phishing, fraud, impersonation or deceptive sites, or collect passwords or payment details under false pretences;
  • send spam, or spread malware;
  • attack, scan or overload any system, or get into anything you're not authorised to access;
  • mine crypto, run proxies or VPNs, or use workspaces or hosting for anything other than building and serving your sites;
  • break out of a sandbox, or get around egress limits, metering or security controls;
  • sell or share access to Plyed itself: your credits, the agent or the models, a shared login, or a service that lets others use them. Selling the sites you build with Plyed, and inviting clients or colleagues to a workspace you pay for, is fine;
  • open more than one free account, come back after we closed or you deleted an account to get free credits again, or make accounts for others to do it;
  • make deepfakes or sexual content involving real people, or break a model provider's usage policy;
  • do anything section 5 forbids, or use the service to build a competing model.

10. Reports, moderation and takedowns

Contact point. legal@plyed.co is our single point of contact for authorities and for users. You can write in English or Czech.

Reporting content. Anyone can report illegal content at abuse@plyed.co. Please include why it's illegal, the exact URL, your name and email (unless the report concerns child sexual abuse), and a statement that you believe the report is accurate and complete. We'll confirm receipt, decide in a timely and objective way, and tell you the outcome and your options for redress. We may act on a report that misses some detail. Copyright notices go to the same address.

How we moderate. We don't monitor content in general. We find content through reports and our own checks. A person decides whether to remove a site or restrict an account for content reasons; we don't do that automatically. Some limits do apply automatically, such as rate limits, spend ceilings, and the hold on a disputed payment in section 13. We apply these rules fairly and proportionately, with regard to everyone's rights, including freedom of expression.

What we may do. We may remove or block a site, preview or other content, or restrict or suspend your account or features, if the content is illegal or breaks these terms, or to protect the service, users or others. We may act straight away and review afterwards. Unless the law or an authority stops us, we'll email you a statement of reasons at the latest when the restriction starts. It will give the decision, where it applies and for how long; the facts behind it, and whether it came from a report or our own checks; whether automation was used; the law or term relied on and why; and how to challenge it.

Challenging a decision. Reply to that email or write to legal@plyed.co within six months. It's free. A person will review it and answer in writing, usually within 14 days. If we got it wrong, we'll reverse it. Illegal or harmful content stays down while we review. You can also go to court or use any out-of-court route open to you. We report suspected crimes that threaten someone's life or safety to the authorities. We end the accounts of users who repeatedly infringe copyright.

11. Published sites and previews

Publishing makes your site public. Preview links work for anyone who has the address. Don't put anything secret in either.

You're the operator of your site. That means you're responsible for its content, its legal notices, privacy notices and cookie choices, any personal data it collects, and any law that applies to your business. We give no assurance that your site complies with any law. Storage and traffic are limited by your plan. If your site's use is far out of proportion to it, we may ask you to change that or limit it. Site names aren't property, and we can withdraw one that misleads or infringes.

12. Workspaces and teams

A workspace owner decides who joins. Members may be able to edit, publish and delete projects and change domains, so only invite people you trust. The owner is responsible for what members do in the workspace and for its billing. We don't referee disputes between you and clients or colleagues over who owns a project or site. We rely on the account records and don't check who really owns it.

13. Plans, credits and payments

Seller. Polar is the merchant of record and reseller for our paid plans and credit packs. You buy from Polar, under the Polar buyer terms, and Polar handles payment, tax, receipts and billing questions. We provide the service and support for it. If the service doesn't conform to the contract, write to us at help@plyed.co, whoever sold it to you.

Subscriptions. Paid plans renew automatically at the shown price, and charges recur until you cancel. You can cancel any time in Account or through Polar's customer portal. Cancelling stops the next charge, and your plan runs to the end of the paid period. Upgrades are charged straight away, in proportion to the time left, and give extra included credits in the same proportion. Downgrades start at the next period.

What credits are. Credits measure use of AI models, cloud workspace time and other metered features. Model use is deducted at what the model costs us, and other features at the rates in our plans and credits guide. So credits run down faster with costlier models, and the same work can cost more if provider prices change.

Models on your own keys, and chats on a coding tool on your computer, don't use credits for the model. Cloud workspace time and other metered features still do. The provider's charge for your own key or tool is between you and the provider.

Credits can't be turned into cash or transferred, apart from the refunds in sections 13 and 14; a workspace's members may use its credits. Included credits reset each billing period (each UTC calendar month on Free) and don't roll over. Free credits are a gift, and we may withhold or remove them where we see farming, telling you why by email. We may reverse credits granted by mistake or fraud, and tell you if we do.

Reservations. While work runs we reserve its likely maximum cost, and release what's unused when it ends. If a final cost never arrives, for example after a crash, we may keep the reservation. We may limit how many runs you start at once.

Credit packs have no expiry date. They last while your account and the service exist. Included credits are used first, then pack credits. Pack credits are held as one balance. Where a refund in this section depends on which pack credits are left, we count the oldest pack as used first. If you delete your account, remaining credits are gone, though a consumer's right to withdraw in section 14 stays until it runs out.

If we discontinue the service, or end your account for any reason other than your breach of these terms or fraud (if you're a consumer, section 15 says what you get back after a breach), we'll on request refund, for each pack, the price you paid multiplied by the unused paid credits and divided by the credits in that pack, less anything already refunded. We'll also refund the unused part of any prepaid plan. Free and bonus credits don't count. Suspending a service isn't ending it; the refund is due when we end it.

Refunds and disputes.

  • Refunds go through Polar, and Polar may also issue refunds at its own discretion within 60 days of purchase.
  • A refund of a pack removes those credits. If they're already spent, the shortfall comes off your next purchase, and we may pause AI features until it's settled. If you withdrew as a consumer under section 14, we reverse that shortfall instead of taking it from a later purchase.
  • A full refund of a subscription payment ends the included credits for that period.
  • If a payment is disputed or reported as fraud, we may block AI features and cloud workspaces until it's resolved. You can still edit on your computer, get your work through the app and Git, and keep your sites up. If you're a consumer, this doesn't affect your rights, and we lift it once it's resolved in your favour. If you're a business user and the dispute was unfounded, we may recover the dispute fee.

Price and plan changes. We'll give at least 30 days' notice of a price increase, a rise in the credits a feature costs, or a material reduction in a paid plan, and you may cancel before it applies and get back the unused prepaid part. A change in a provider's price passing through to the credits a request uses isn't such a change. Free plans and free credits may change at any time.

14. Your right to withdraw (consumers)

If you're a consumer in the EU, or in a country with a similar right, you can withdraw from a purchase of a plan or credits within 14 days of buying, without giving a reason.

Withdraw from contract here, or send any clear statement to help@plyed.co or Polar, for example: "I withdraw from my contract for [plan or pack], bought on [date], in the name of [name], [email]." You only need to send it before the 14 days end. We'll confirm by email with the date and time, and you'll get your money back within 14 days of our learning of your decision, by the same payment method, through Polar.

If, when you bought, you expressly asked us to start during those 14 days and confirmed you understood the consequences, you pay only for what you used up to withdrawing, or for digital content already supplied, you may have lost the right. If you didn't, you owe nothing for that time. Either way, the credits from that purchase come off your account.

15. Suspension and ending

You may stop at any time. If you have an active plan, cancel it first, because deleting your account doesn't cancel it for you. To delete your account, write to help@plyed.co. We'll tell you any paid credits you'd lose, and complete deletion within 30 days. Deleting removes your account data as set out in the Privacy Policy, takes down your sites and ends remaining credits. A project you share with another owner passes to them. Copies on your computer aren't touched.

We may suspend or end your account or a feature:

  • straight away, if you seriously break these terms, don't pay, or for security or legal reasons;
  • if a provider we rely on requires it, with as much notice as that provider lets us give;
  • with at least 30 days' notice, for any other reason, including ending a feature, the alpha or the service.

Breaking section 9, fraud, and abusing credits or payment disputes in bad faith count as your fault. If we end your account because of that:

  • business users get no refund, and credits are lost;
  • consumers get back the unused part of any prepaid period and unused paid credits, less our actual loss from the breach, unless the breach was fraud, a dispute in bad faith or illegal content.

When your account ends through no fault of yours, we'll help you retrieve content we hold, free of charge, for 30 days. Before that it stays available through the app and Git. Afterwards we delete it as the Privacy Policy describes.

If you leave with a payment dispute open, or after we closed your account for breaking these rules, we may keep your email (or a hash of it), the dispute and the reason, and refuse a new account until it's settled.

Sections that by their nature should continue, including 5, 6, 9, 13, 16, 17, 18, 20 and 21, continue after the contract ends. We rely on other companies to deliver the service; if one of them suspends or changes what it provides, we may need to do the same.

16. Personal data

The Privacy Policy says how we handle personal data as controller. For business users, where your content contains other people's personal data (for example, your clients', staff's or site visitors'), you're the controller and we process it for you as processor. That covers whatever data you put in your projects and sites, for as long as this contract runs, for hosting, storage, AI processing and the other features you use. Then:

  1. We process it only on your documented instructions, which are these terms and how you use the service, including for transfers, unless the law requires otherwise, and we'll tell you first unless the law forbids it. We'll tell you if we think an instruction breaks data-protection law.
  2. People we authorise to process it are bound to confidentiality.
  3. We take appropriate security measures.
  4. You authorise the sub-processors listed in the Privacy Policy. We bind them to equivalent duties, answer for them, and update that list before adding one; you may object by stopping use of the affected feature.
  5. We help you, as is reasonable, with data-subject requests, security, breach notification and required assessments.
  6. When the service ends we delete or return the data, at your choice, apart from what the law requires us to keep and backups that expire on their own.
  7. We give you the information needed to show compliance, and allow for and contribute to audits on reasonable notice, at your cost.
  8. Where personal data leaves the EEA, we rely on a transfer mechanism GDPR allows.

17. Warranties and liability

If you're a consumer, you keep every right the law gives you, including rights if the service doesn't conform to the contract. Nothing in these terms limits those rights or our liability where the law doesn't allow it.

If you're a business user, then as far as the law allows:

  • the service is provided "as is" and "as available", without warranties, including of fitness for a purpose, non-infringement, or that it will be uninterrupted or error-free;
  • we aren't liable for lost profits, revenue, business or goodwill, or for indirect loss;
  • our total liability for all claims arising in a contract year, including loss caused by AI output, the agent's actions or lost data, is limited to the greater of what you paid for the service in the 12 months before the claim and EUR 100. A contract year starts when you first accepted these terms and on each anniversary.

If a court finds a limit in this section unenforceable against you, our liability is limited to the most the law allows, and the rest of the section stands.

For everyone, nothing in these terms excludes or limits liability for intent or gross negligence, for harm to a person's life, health or other natural rights, or for anything else the law says can't be excluded or limited.

18. Responsibility for claims (business users)

If you're a business user, you'll cover our reasonable losses and costs from third-party claims caused by your content, your sites, your use of AI output or your breach of these terms, including claims by your clients about sites or work you delivered using Plyed, except to the extent caused by our breach of these terms, our intent or our gross negligence. We'll tell you about the claim promptly and let you take part in the response. This section doesn't apply to consumers.

19. Changes

To the service. We may change the service, at no extra cost, to keep it working and secure, to comply with the law, to respond to a provider's change, to fix errors, or to add, change or remove a feature. We'll tell you clearly about changes that matter. If a change noticeably harms your use of the service, we'll email you at least 30 days ahead and you may end the contract free of charge within 30 days of the notice or the change, whichever is later, and get back any unused prepaid amount, unless we let you keep the old version at no extra cost.

To these terms. A material change is one affecting price, scope, liability, data use or your rights. We'll email you at least 30 days before it applies, and show it on this page, except when security or a legal requirement needs it sooner.

  • If you're a business user and don't end the contract before that date, the change applies.
  • If you're a consumer, a change that isn't in your favour binds you if you accept it when we ask, or if it's needed because the law, a provider's terms, security or an error requires it, or adds a feature or fee you aren't forced to use. You may end the contract free of charge within 30 days of the notice.

Either way, if you end the contract because of the change, we'll refund any unused prepaid amount.

20. Law, courts and disputes

Czech law governs these terms, without its conflict-of-law rules. The UN Convention on Contracts for the International Sale of Goods doesn't apply.

Consumers. You keep the mandatory protection of the law where you live, and you may bring a claim there or in the Czech Republic. We can sue you only where you live. To claim under the legal guarantee, write to help@plyed.co describing the problem, and we'll answer within 30 days. Consumers can use out-of-court dispute resolution through the Czech Trade Inspection Authority (Česká obchodní inspekce, coi.gov.cz/informace-o-adr), which also supervises consumer protection, and consumers elsewhere may also have a body in their own country.

Business users. The courts of Prague, Czech Republic, have exclusive jurisdiction, except that we may seek urgent relief wherever necessary to protect our rights.

21. General

These terms and the documents they link are the whole agreement on their subject. If you're a business user, you haven't relied on statements outside them. If they conflict with another Plyed document, these terms prevail, but the Privacy Policy controls on personal data. Polar's terms prevail on the sale and payment, but we still honour the refunds in sections 13 and 14, and nothing in either removes a right the law gives you.

Nobody other than you and us has rights under these terms. If you build for a client, you answer to the client, and we owe them no duty under this contract.

If a part is invalid, the rest stands, and that part is replaced by the closest valid rule. Not enforcing a right doesn't waive it. We aren't responsible for failures caused by events outside our reasonable control, including provider, network and power outages; for consumers, this doesn't limit your rights if the service doesn't conform.

We may transfer this contract to a successor or a company taking over Plyed, and we'll tell you. For consumers, this won't reduce your rights, and you can end the contract if you object. You can't transfer it without our consent. We send notices to your account email; send yours to legal@plyed.co. You must comply with export-control and sanctions laws.
